روایت «مَنْ تَعَدَّى فِی الْوُضُوءِ کَانَ کَنَاقِضِهِ» در ترازوی نقد

چکیده
در نظر برخی از حدیث پژوهان، روایت«مَنْ تَعَدَّى فِی وُضُوئِهِ کَانَ کَنَاقِضِه»ممکن است دلالت بر تعداد شستن در وضو یا تعدی در مسح کردن یا تعدی در مقدار آبِ لازم برای وضو یا شستن به جای مسح کردن داشته باشد. در نوشتار حاضر با بهره گیری از منابع کتابخانه ای و روش توصیفی تحلیلی، باید گفت: سند این روایت با توجه به موثق بودن راویان آن،موثقه است واز منظر فقه الحدیث با بررسی آیات قرآن و روایات و حکم عقل به این نتیجه رسیدیم که مراد امام معصوم (ع)، این است که اگر کسی مبتلا به وسواس باشد و چند بار وضو بگیرد، وضویش باطل است؛ بسیاری از روایت ها به صورت صریح و با دلالت تطابقی، و برخی از روایات به دلالت التزامی و به صورت تأیید کننده، حرمت تعدی و چند بار وضو گرفتن را بیان می کنند وروایات مخالف را به دقت عرفی می توان به دو صورت جمع کرد که بار دوّم را از باب استحباب گرفت همان طور که فقهاء نیز به آن فتوا داده اند یا اینکه گفت: منظور از تعدی که ناقض وضو است، شستن اضافه بر بار دوّم یعنی همان بار سوّم است که به اجماع همه فقهاء مبطل وضوست.The Hadith "Whoever Transgresses in Ablution Is as Its Violator" in the Scale of Criticism
In the viewpoint of some hadith scholars, the hadith "whoever transgresses in ablution is as its violator" may refers to the number of washings or an excess in ablution or an excess in the amount of water which is required for ablution, not the wipe in ablution. In the present survey, which studies the library sources by a descriptive-analytical method, it is revealed that the hadith is authentic due to the reliability of its narrators, and from the juridical point of view. By studying the verses of the Holy Quran, hadiths, and rational reasoning, it could be concluded Imam (AS) refers to a person who has obsession and performs ablution several times and therefore his ablution is invalid. Many hadiths express the prohibition of transgression in ablution and its performance for several times explicitly, implicitly, and confirmatory. The opposing hadiths can be summed up in two ways: 1) the second time washing could be accepted as a prescribed matter which is in accordance with fatwa or 2) which means transgression, is washing more than two times and refers to third washing, the issues makes the ablution unacceptable according to all jurists' consensus.
