چکیده
گردشگر مذهبی یکی از متداولترین انواع گردشگری است، چرا که امروزه بیشتر مردمان جهان یک آئین اعتقاد دارند همین امر باعث ایجاد گردشگری مذهبی در سطح جهان بصورت گسترده شده است؛ از طرفی این نوع از گردشگران در معرض خطر بیشتری نسبت به دیگر انواع گردشگران می باشند، که این امر نشات گرفته از باورهای مذهبی آنان بوده، آنچنان که بعضا علاوه بر مال، جان آنان نیز به مخاطره می افتد. بنابراین ما درصددیم بدانیم چه ترتیبات حمایتی از این نوع گردشگران در عرصه بین الملل در قالب اسناد وجود دارد. آیا اگر حقوق مربوط به گردشگر مذهبی تضییع شود، حقوق بین الملل و اسناد جهانی می توانند به کمک آنان آمده و از آنان حمایت کنند؟ بنابراین هدف و انگیزه ما از این پژوهش بررسی و شناخت اسناد کاربردی جهانی به منظور مقابله با تضییع حقوق گردشگر مذهبی، تا با بکارگیری مناسب آنان نزد مراجع قضایی و شبه قضایی منطقه ای و بین المللی در بدو امر موجبات پیشگیری و در مراحل بعدی نیز احقاق حق نسبت به حقوق تضییع شده آنان گردد. روش تحقیق در این پژوهش به صورت توصیفی تحلیلی است، نتایج تحقیق نیز نشان داد که اسناد مختلف در عرصه بین الملل وجود دارد؛ که قطعا تاثیر مناسبی درکاهش تضییع حقوق گردشگرمذهبی می تواند، داشته باشد. کشورها با استفاده از اسناد عام و خاص قادرند، بسیاری از تنش های سیاسی، اقتصادی اجتماعی را در جهان کاهش دهند. از طرف دیگر با شناخت اسناد حمایتی دولتمردان شخص گردشگرقادر است، درپی حقوق تضییع شده و همچنین خواستار جبران خسارات گردند.Supportive Arrangements of Religious Tourists in the Global Documents
Religious tourism is one of the most common types of tourism because nowadays most people in the world believe in one religion, and this has led to establishing religious tourism around the world; On the other hand, this type of tourism is more at risk than other ones which are due to the religious beliefs, so that sometimes the tourists’ properties and lives are endangered. Therefore, we seek to find out what supporting services for this type of tourist exist in the form of documents internationally. Can international laws and global documents help and support them if their rights as religious tourists are violated? Therefore, the purpose and motivation of this study were to study and recognize the practical documents of the world to deal with the violation of the rights of religious tourists so that they can be properly used by regional and international judicial and quasi-judicial authorities in the first place to prevent and later to realize the rights concerning the tourists’ violated rights. The research method is descriptive-analytical. The research results showed that there are various documents in the international arena; which can certainly have a positive effect on reducing the violation related to religious tourism rights. Countries can reduce many of the world’s political, economic, and social tensions by using general and specific documents. On the other hand, by recognizing the supportive documents of the government officials, the tourists can seek the rights that have been violated and also demand compensation.
