چکیده
تأثیر شناسایی و به کارگیری قاعده های نوی فقهی، در توانمند سازی بیش از پیش فقه شیعه، در جریان استنباط و تحلیل احکام فقهی و به تبع آن، در گسترش و تعالی فقه شیعه و نیز افزایش توان و کارآمدی آن در حوزه ی پاسخگویی به نیازها و مسائل نوین جامعه، انکار ناپذیر است. انصاف و عدالت، یکی از مدخل های مهم در ابواب متعدد دانش فقه است که شمار چشمگیری از احکام فقهی، به آن، مشروط و یا معطوف است و امروزه، در ادبیات فقه، از منظرهای مختلف درونی و بیرونی به آن نگریسته می شود و با رویکردهای متفاوت، درباره ی آن، سخن می رود؛ از این رو، نوشتار حاضر می کوشد، با هدف شناسائی قاعده ی انصاف که البته، ادبیات فقه شیعه با آن، آشنایی دیرین دارد و در لا به لای اندیشه ها و نوشته های فقهی فقیهان شیعه، جاری و مس تور است، مبانی اثبات پذیری نگره ی قاعده نگاری انصاف را بیان دارد و نمونه هایی از کاربرد آن را در ادبیات فقه شیعه، نمایان سازد.The view of the rule of justice with an approach to the literature of Imami jurisprudence
The effect of identifying and applying the new rules of jurisprudence, in empowering Shiite jurisprudence more, during the inference and analysis of jurisprudential rules and, consequently, in the expansion and excellence of Shiite jurisprudence and also increasing its power and efficiency in the field of accountability It is undeniable to the new needs and issues of the society. Fairness and justice is one of the important interventions in various chapters of jurisprudence that a significant number of jurisprudential rules are conditional or focused on it and today, in jurisprudence literature, it is viewed from different internal and external perspectives. And it is talked about with different approaches; Therefore, the present article tries to identify the rule of fairness with which, of course, the literature of Shiite jurisprudence is long familiar and is current and prevalent alongside the ideas and jurisprudential writings of Shiite jurists. It lays the foundations for the provability of the normative view of fairness and shows examples of its application in the literature of Shiite jurisprudence.
