چکیده
از نظر تحول تاریخی دولت در دوران دولت مدرن و از نظر برخی در دوران دولت فرامدرن به سر می بریم. در قانون اساسی جمهوری اسلامی نیز برخی از مؤلفه های دولت مدرن پذیرفته شده است، ازاین رو ساختار اداره کشور نیز باید بر اساس ساختار یک دولت مدرن استقرار یابد، اما نویسنده معتقد است در عمل در حوزه نحوه اداره امور کشور نوعی فئودالیسم اداری در ایران شکل گرفته است که آثار مخربی در اداره کشور دارد. در این مقاله وجود نهادهای موازی، تأسیس نهادهای فرا قانون اساسی، دادن اختیارات به مقامات به ویژه مقامات خارج از قوه مجریه، جهت اقدام در اموری که خارج از وظایف ذاتی آنهاست، نفوذ اشخاص و مراجع غیررسمی در تصمیمات دستگاه های عمومی از جلوه های شکل گیری فئودالیسم اداری در ایران است و این امر نوعی عقب گرد در شیوه اداری کشور است. این نحوه عملکرد موجب شده است که تصمیمات دستگاه های اداری غیرقطعی و متزلزل و تغییرپذیر شوند، ازاین رو نویسنده معتقد است که اولین گام برای اصلاح روند اداره امور کشور و از بین بردن فئودالیسم اداری، تمرکز امور در نهادهای ذیصلاح قانونی بر اساس اصل تفکیک قوا و وظایف ذاتی هر دستگاه است.The Formation of Administrative Feudalism in Iran
In terms of the historical evolution of the state, we are living in the era of the modern state, and according to some, in the era of the post-modern state. In the constitution of the Islamic Republic, some of the components of the modern state have been accepted, so the structure of the country's administration should also be established based on the structure of a modern state, but the author believes that a kind of administrative feudalism has been formed in Iran in the field of the administration of the country's affairs, which basically has a destructive effect on the administration of the country. In this paper, the existence of parallel institutions, the establishment of extra-constitutional institutions, giving authority to authorities to act in matters that are outside of their inherent duties, the influence of unofficial persons and authorities in the decisions of public institutions are among the manifestations of the formation of administrative feudalism in Iran. This is a kind of backwardness in the administrative method of the country. This way of functioning has caused the decisions of the administrative bodies to become uncertain, shaky and changeable, so the author believes that the first step to reform the process of running the affairs of the country and eliminate feudalism is to concentrate affairs in legally competent institutions based on the principle of separation of powers.
