چکیده
بحث تعطیلی یا تعدیل حدود و یا اجرای کامل آن در دوران معاصر که دوران غیبت امام معصوم (ع) است، بحثی است که سالها مورد اختلاف فقها بوده است که هر کدام از آنها با مراجعه به روایات و آیات، سعی در اثبات نظرات خود داشته اند. در این سیاست جنایی حدود الهی به دو بخش قبل از اثبات و بعد از اثبات قابل تقسیم است. بدین نحو که مرتکب با مراجعه به صاحب حق می تواند از او درخواست کند از اجرای مجازات صرف نظر کند و با او مصالحه کند. نتیجه شناسایی اثر سلبی احکام کیفری صادره از محاکم خارجی و تضمینی بنیادین برای رعایت حقوق متهم و محکوم علیه و ابزاری کارآ جهت تعدیل رفتار حکومت ها در اعمال حاکمیت و مجازات است. اثر سلبی احکام کیفری صادره از محاکم خارجی و تضمینی بنیادین برای رعایت حقوق متهم و محکوم علیه و ابزاری کارآ جهت تعدیل رفتار حکومت ها در اعمال حاکمیت و مجازات است.A comparative inquiry into realism or expediency about the punishment of limits From the perspective of Islamic humanities with emphasis on the teachings of Islamic criminology
