تأملی پیرامون معانی «حکم ارشادی» (مقاله علمی وزارت علوم)

چکیده
یکی از اصطلاحات پرکاربرد در دانش فقه و اصول و در خصوص اعتبارهای شرعی، مولوی یا ارشادی بودن حکم است. با وجود کاربردهای نسبتاً زیاد اصطلاح «حکم ارشادی» در متون اصولی و فقهی، بحث مستقلی پیرامون معانی و مفاهیم چندگانه این مصطلح رؤیت نمی شود که همین زمینه را برای خلط مبحث ها و عدم وضوح مطالب مربوط پدید آورده است. بر پایه این پژوهش که در راستای تبیین معانی حکم ارشادی با جستجو در مباحث و زمینه های مختلف کتب فقهی و اصولی انجام شده، اصطلاح «مولوی» یا «ارشادی» بین چند معنا و مفهوم اشتراک لفظی یافته است: 1. ارشاد به حکم وضعی، نه حکم تکلیفی مولوی؛ 2. ارشاد به حکم شرعی الهی در مقابل حکم مولوی حکومتی؛ 3. ارشاد به مصالح دنیوی بدون تأثیر اخروی؛ 4. ارشاد به درک عقل در کشف حکم شرعی؛ 5. ارشاد به بنا عقلا در فرض استقلال آن در کشف حکم شرعی و 6. بیان حکم متقدم یا متأخر از ثبوت حکم شرعی(سلسله معالیل). به جز اشتراک در مدلول لغوی، وجه مشترک بین این معانی منتفی است و هر یک از احکام شرعی ممکن است با توجه به یک معنا ارشادی و با توجه به معنای دیگری مولوی باشد.Reflections on the meanings of Guidance
One of the most commonly used terms in jurisprudence and principles is the verdict on the validity of Shari'a, Rumi or guidance. Despite the widespread use of the term guidance in the Principal and jurisprudential texts, however, there has been no independent discussion of the multiple meanings and concepts of this term. And it has created the same context for confusing topics and unclear content. Based on this research that has been done in order to explain the meanings of the guidance of the jurisprudence by searching on different topics and areas of jurisprudence and theology, the term Rumi or guidance has been found between several meanings and concepts of literal sharing. 1. Guidance on the Ruling. 2. Guidance on Divine Shariah Ruling Against Ruling Government. 3.Guidance to worldly materials without affecting the Hereafter. 4. Guidance for understanding reason in discovering religious law. 5. Reasonable guidance in assuming its independence in the discovery of the Sharia. 6. Expressing the Early or Late Sentence of the Confirmation of the Shariah Sentence. Except for the literal signification, the commonality between these meanings is neglected, and each of the religious injunctions may be in one sense guided by another meaning in Rumi.
