حمایت کیفری از کودکان درمقابل سوءاستفاده در فضای مجازی در قوانین ایران و انگلیس و اسناد بین المللی (مقاله علمی وزارت علوم)

چکیده
با افزایش میزان مشارکت کودکان در فعالیت های برخط، استفاده از اینترنت بیش از دیگر رسانه ها برای اجتماعی شدن و برقراری ارتباط مورداستفاده کودکان قرار گرفته است. فقدان تجربه و آگاهی لازم در رابطه با تکنولوژی های اطلاعاتی و ارتباطی مدرن پدیده سوءاستفاده از کودکان در فضای مجازی را به عنوان یک نگرانی مشترک در جامعه بین المللی پدیدار کرده است. ازجمله یافته های این مقاله، اهمیت اینترنت و تکنولوژی های ارتباطی برای اجتماعی شدن، اشکال و قلمرو سوءاستفاده از کودکان در فضای مجازی و اهمیت جلوگیری از آن و بیم کودکان از افشای موارد سوءاستفاده برخط به سایرین، خصوصاً والدین می باشد، بنابراین نقش دولت ها و سازمان های بین المللی در این رابطه حیاتی است تا از کودکان درمقابل سوءاستفاده برخط حمایت مقتضی به عمل آورند، البته جرم انگاری سوءاستفاده برخط از کودکان، ازجمله اقدامات پیشگیرانه و مهم به شمار می آید. قانونگذار ایران، انتشار محتویات مستهجن، آموزش و تسهیل ارتکاب به اعمال منافی عفت در فضای مجازی، انتشار تصویر خصوصی افراد و ... را جرم انگاری کرده است، اما قوانین انگلستان و اسناد بین المللی داشتن، توزیع، به اشتراک گذاری و یا ساخت تصاویر مستهجن از کودک را جدای از موارد فوق جرم می داند؛ بنابراین فقدان حمایت خاص از کودکان و عدم تفکیکِ دقیق بین نوع اعمال ارتکابی در نظام حقوقی ایران احساس می شود و متعاقباً به امکانِ مفسد فی الارض شناخته شدن افراد کم سن و سال، به واسطه شرکت در تولید فیلم مستهجن، پیدایش کودک ِ کارِ مجازی و ورود سیلی از پرونده ها به دادگاه با ادعای نقض حریم خصوصی در کودکی در سال های آینده می انجامد.Criminal Protection of Children against Online Abuses in Iran and UK Regulations and International Documents
Empirical data show that increasingly children are engaging in online activities. Children and youths use electronic technology such as the Internet more than any other medium through which to communicate and socialize. Many children lack experience and knowledge of the implications and practices related to information and communication technologies, then the phenomenon of cyber abuses from children's and youths' perspectives has become a common concern in the international community as a whole. Findings revealed the regularity and importance of the Internet and communication technology for socialization; the forms, extent, and impact of cyber abuse; and children' fear of disclosing cyber abuse to adults, particularly parents. So the role of the states and international organizations in this relation is vital to protect the children from the online abuses and the criminalization of online abuses of children is one of the protective and important measures. Iranian lawmaker criminalizes dissemination of pornographic contents and private pictures, also training and facilitating these crimes in cyberspace. English Law and international documents criminalize possessing, distributing, sharing or making pornographic images of a child is an offense. Therefore, the lack of specific protection for children and precise distinction between these types of acts committed in the Iranian legal system are felt. It will lead to many lawsuits concerning child labor, child crimes and privacy violation in the future.
