چکیده
از مشکلاتی که سیستم قضایی ایران با آن دست و پنجه نرم می کند اطاله دادرسی و مشکلات آن است. اگر بخواهیم پیشینه این مشکل را مورد بررسی قرار دهیم باید برگردیم به همان زمانی که سیستم قضایی و دادگاه ایران تاسیس شد.این مشکل نه تنها طرفین یک دعوی یا شکایت را رنج داده و کلافه می کند، بلکه باعث آزار خود کارکنان و قضات سیستم نیز می شود. از عواملی که باعث اطلاله دادرسی شده و می توان گفت که مهم ترین عامل ایجاد آن هم است، کثرت و زیادی پرونده های مطروحه در مراجع قضایی است. مشکل اطاله دادرسی که در سیستم قضایی کشور ما ایجاد شده است باید از سوی رئیس قوه قضاییه حل شود و برای حل آن به خوبی چاره اندیشی بشود.از دیگر عواملی که ممکن است موجب اطاله دادرسی در مورد پرونده شود، سرخود عمل کردن طرفین دعوی و عدم اخذ یک وکیل یا مشورت با مشاور حقوقی است. هدف از این پژوهش بررسی، تأثیر عملکرد شورای حل اختلاف بر اطاله دادرسی در پرونده های حقوقی و کیفری، بود که بصورت توصیفی و کمی انجام شد.نتایح پژوهش حاکی از تایید سوالات پژوهش بود و در این راستا شوراهای حل اختلاف در سراسر کشور تشکیل شد . کاهش اطاله دادرسی و صلح و سازش بین طرفین از دیگر اهداف این شوراها است. از جمله محاسن شوراهای حل اختلاف : کاهش مراجعات مردم به محاکم قضایی، رفع اختلافات محلی، حل و فصل اموری که ماهیت قضایی ندارد یا از ماهیت قضایی کمتری بر خوردار است،The effect of the performance of the dispute resolution council on the delay of proceedings in legal and criminal cases
