چکیده
احکام شرعی ازنظر مورد ابتلا بودن، در یک درجه قرار ندارند؛ بعضی محل ابتلای همگان یا اکثر متشرعان و برخی دیگر محل ابتلای افرادی خاص است و یا حتی اگر اغلب را مبتلا سازد، محدود به مدت زمان خاصی است. پدیدهٔ عموم بلوا در بسیاری از مسائل مرتبط با علم اصول فقه بازتاب داشته است. اهمیت و حساسیت مسائل عام البلوی و نیاز شدید به آن ها سبب سخت گیری و دقت نظر فزون تر در به کارگیری ادلهٔ احکام شده است. در این نوشتار، ابتلای عمومی و میزان دخالت آن در عرصه های گوناگون اصول فقه به روش توصیفی تحلیلی تبیین شده است. عام البلوی بودن در ملاک حجیت ادله ای چون سنت و اخبار منعکس شده است؛ به طوری که اکثر محققان معتقدند که روایات عام البلوی بایستی علم آور باشد یا دست کم از شهرت و شیوعی بیش از سایر روایات برخوردار باشد. از سوی دیگر، عام البلوی بودن در تثبیت موضوع سیره و اجرای اصل برائت اثرگذار است و به ضمیمهٔ نرسیدن ردع شارع، دلیل بر احراز عدم ردع محسوب می شود و درنتیجه حجیت سیرهٔ عقلا را در پی دارد.The reflection and functions of the public Balva-involvements- phenomenon in the issues of principles of jurisprudence

The phenomenon of public Balva has been reflected in many issues related to the science of principles of jurisprudence. The importance and sensitivity of common law issues and the strong need for them have caused more severity and double precision in the application of the evidence of rulings. In this article, the general Ibtela (involvement) and the size of its involvement in various fields of the principles of jurisprudence have been explained in a descriptive and analytical way. Being generally involved is reflected in the criterion of the authenticity of evidence such as tradition and Akhbar ; So that most researchers believe that Am al-Bal va narrations should cause knowledge or at least they are more famous and spread than other narrations. On the other hand, being Am al-Balva is effective in establishing the subject of Sireh and implementing the principle of Beraat , and in addition to the absence of legal prohibition, It is considered as a proof of the lack of prohibition, and as a result, it leads to the validity of the wise's Sireh .
