چکیده
علم اصول، دانش مطالعه ادله ی فقه است و قوانین استنباط در فقه را ارائه می دهد؛ اما پرسشی مهم درباره ی روش شناسی دانش اصول وجود دارد که: ادله ی خود علم اصول چیست و علم اصول خود بر اساس چه قواعدی استدلال می کند؟ پاسخ به این پرسش، مبانی تولید و توسعه و پالایش و نقد و ارزیابی در دانش اصول را تبیین می کند و بر اساس این ضرورت، پژوهه ی فرارو به استقرا در آثار و آراء اصولی حضرت امام خمینی پرداخته است تا ادله ی علم اصول را در یک مطالعه ی موردی از منظر ایشان کشف کند. تحقیق حاضر پس از تجمیع قواعد استدلال ایشان در تک تک مسائل علم اصول، به تعیین الگوهای مشترک در این موارد که مقتضای روش استقرار است پرداخته و در نتیجه به الگویی کلی از روش های استدلال اصولی دست یافته است. این الگو شامل نه دلیل است: تحلیل لغوی که عبارت است از تحلیل تبادری؛ تحلیل عرفی که یا به صورت تحلیل عقلائی (سیره عقلائیّه) است و یا اطلاق گیری و یا تحلیل عملکرد موالی عرفیّه؛ ارتکازات فطری که نیازمند استدلال نظری نیست و خود دلیل است؛ دلیل عقلی که همان اقامه برهان به روش عقل فلسفی است؛ دلیل نقلی که شامل روایات معصومان است؛ دلیل ترکیبی که خود بر دو قسم است: دلیل عقلی – نقلی و دلیل عقلی - لفظی. پژوهه فرارو علاوه بر استخراج این الگوی استقرائی، در هر مورد از تبیین چیستی هر یک از ادلّه و ابعاد آنها و مباحث آسیب شناختی پیرامون آنها نیز دریغ نکرده استReason of Usul Science from the Perspective of Imam Khomeini (General Method of Ijtihad in Usul Science)
Usul science is a knowledge to study reasons of fiqh and to represent the rules of inference in fiqh. But there are very important questions about methodology of Usul science. What are reasons of Usul science? What rules does Usul science argue? Response to these questions explains the foundations of production, development, refinement, critique and evaluation in Usul science. So the current study aims to draw an inference from Imam Khomeini's original works and opinions, so reasons of Usul science can be investigted in a case study from his perspective. In this study, the rules of reasoning are summerized in each problem of Usul science and then common patterns that are subjected to inductive method in these cases are defined. Consequently, general pattern is achieved from methods of Usul reasoning . This pattern has nine reasons: lexical analysis that refers to analysis of word’s first meaning that comes to mind; conventional analysis comes in 3 forms: rational analysis (rational method), generalization (speech refers to common noun and thing) or performance analysis of conventional masters; innate understanding that does not need theoretical reasoning because it itself is reason; rational reasoning that is argumentation based on philosophical wisdom; narrative reason that includes narratives of infallibles; hybrid reason comes in two forms: rational – narrative reason and rational – literal reason. In addition to extracting this inductive pattern, the current study does not ignore the explanation of each reason’s quiddity, their dimensions and pathological discussion around them.
