بررسی روش استنباط اطلاقات از طریق اجرای مقدمات حکمت (مقاله علمی وزارت علوم)

چکیده
یکی از کاربردی ترین ابزارهای استنباط احکام در فقه و حقوق اسلامی، احراز دلالت لفظ بر اطلاق از طریق «مقدمات حکمت» است که این نوشتار به بررسی زوایای مختلف آن می پردازد. در این راستا، نظریات اصولی پیرامون وضع الفاظ مطلق، مورد نقد و بررسی قرار گرفته و از بین اقوال قدما و متأخرین، پنج مقدمه تحت عناوین زیر: «در مقام تمام بیان مراد بودن متکلم، عدم قرینه بر تقیید، عدم قدر متیقن در مقام تخاطب، امکان اطلاق و تقیید و عدم انصراف» به دست آمد. سپس راجع به هر یک از مقدمات موصوف از جهات مقصود از آن مقدمه، اعتبار مقدمیت و راه احراز آن بحث شد. در نهایت با بررسی نظریات و آرای اصولی ها و ادلّه استنادی آنها مشخص گردید که دلالت مطلق بر اطلاق، عقلی است و این دلالت توسط قرائن اثبات می شود و صرفاً مقدمیت مقدمه اول را برای استنباط اطلاقات نمی توان انکار کرد اما مقدمیت سایر مقدمات قابل قبول نمی باشد. بنابراین، قرینه عامه یا حکمت تنها یک شرط دارد و آن هم «در مقام بیان تمام المراد استعمالی بودن متکلم» است؛ یعنی گوینده در مقامی باشد که بخواهد تمام مقصودش را بیان کند و برای احراز این مقدمه می توان از اصل عقلایی اصاله البیان استفاده کرد.Surveying the Method of Inference Generalizations by Implementation of Wisdom Rudiments
One of the most utilizations of inference tools of Orders in Islamic jurisprudence and law is to obtain the indication of word against generalization by wisdom rudiments. The current article reviews different aspects of that issue. Accordingly, the principal theories about the status of absolute words are reviewed and criticized. Between words of past and last people, five prefaces is obtained such as the whole aspiration form, asymmetry against encumbrance, lack of encumbrance value in terms of addressee, possibility of generalization and encumbrance and lack of refusal. Then each of mentioned prefaces was discussed according to the purpose of that preface, reliability of priority and the way of obtaining that. Finally by reviewing the theories and opinions of principles and their documentary proofs, it was ascertained that absolute indication is rational. So common symmetry or wisdom has just one condition, that is the speaker be in the form of expressing all his/her purpose and for the obtaining this preface, the use of rational principle of original expression is applicable.
